Be Free Evo is a monthly subscription rental service provided by DRIVALIA S.p.A. reserved for Be Free Evo Voucher holders purchased through Amazon, drivalia.com website or at DRIVALIA Mobility Store.

Premises

Be Free Evo is a monthly subscription rental service provided by DRIVALIA S.p.A. reserved for residents of Italy who have purchased Be Free Evo Voucher through Amazon, drivalia.com or at DRIVALIA Mobility Store.

DRIVALIA S.p.A. will provide rental at all DRIVALIA Mobility Stores in the country upon acceptance of the following contract documents:

  • Terms and Conditions Voucher Be Free Evo herein referred to, viewable at the Amazon Be Free Evo product page or at DRIVALIA Mobility Store;

  • Terms and Conditions of Be Free Evo DRIVALIA subscription, set forth in this document;

  • "DRIVALIA General Rental Conditions" which are hereby referred to and viewable through their respective links.

The subscription called "Be Free Evo" guarantees the customer the same rates and conditions of service use for up to 24 months.

The customer, following the purchase of the voucher and upon registration and activation of the subscription on the drivalia.com website, will be able to rent a vehicle already within the DRIVALIA fleet with a minimum duration of 30 days and a maximum duration of 360 days. The customer agrees to return the original vehicle within the aforementioned maximum period of 360 days so that he/she can then proceed to make the car exchange with simultaneous issuance of a new rental contract that will have a maximum duration of additional 360 days. At the end of the 24-month subscription period, the service will automatically terminate with no possibility of tacit renewal resulting in the customer's obligation to return the last vehicle in use at the time of said termination. In any case, this is without prejudice to the right of DRIVALIA, in its sole discretion, to be able to inspect the vehicle to check its condition or require the return of the vehicle and/or not to replace the vehicle at the outcome of the evaluations of the requirements of the general conditions of the rental contract. DRIVALIA , during the Be Free Evo subscription, reserves the right not to provide a replacement vehicle in case of accident, breakdown, theft, damage or for any other reason at its sole discretion, without having to justify such refusal ("DRIVALIA General Rental Conditions"). These terms and conditions regulate the use of the aforementioned service, "Service" being understood to mean the provision of rental cars with a predetermined duration of 30 days, provided by DRIVALIA .

1. Be Free Evo subscription rental service requirements and prohibitions

The Customer, a signatory of the rental contract, can be the holder of only one Be Free Evo subscription and, in any case, the holder of only one subscription among those offered by DRIVALIA also in order to have access to the subscription service must have the following requirements:

  • Possession of an "Entry voucher" previously purchased on amazon.com, on drivalia,com or at DRIVALIA Mobility Store.

  • Minimum age of 21 years and possession of a valid driver's license for at least one year; Possession of a valid identity document;

  • Possession of tax identification number and residence in Italy;

  • possession of a credit card in the name of the contract holder and issued in the customer's country of residence, the latter to be compulsorily shown when collecting the car as a valid means of payment (ATM cards, debit cards, visa electron or prepaid cards are not allowed).

It is generally forbidden to sub-lease the vehicle in any capacity whatsoever, to entrust it to third parties not authorized by the rental agreement, to dispose of the vehicle contrary to or contrary to the provisions of the rental agreement (General Rental Conditions Letter E - Use of the Vehicle). It should be noted that for premium cars, as specified in the DRIVALIA General Rental Conditions and in the BE FREE EVO PRICING section of the drivalia.com website, the customer, a signatory of the rental agreement, must provide 2 financial credit cards in his or her name, both issued in the same country of residence of the customer, in order to allow on each of the cards presented the acquisition of a security deposit.

It remains subject to the unchallengeable judgment of DRIVALIA to assess the requirements for access to the DRIVALIA Be Free Evo subscription, in accordance with the General Rental conditions.

2. Description of Service and minimum and maximum duration

Following the purchase of the Be Free Evo voucher, the Customer has the right to register on the drivalia.com website and, upon reservation, to rent at DRIVALIA Mobility Stores, one of the car models included in the predetermined range within the chosen tariff plan.

The customer will be able to use the voucher within 30 days from the date of purchase, and will be able to book a vehicle pickup on a date no later than 30 days after the reservation is entered.

The cars provided by DRIVALIA for the Be Free Evo rental service are already part of the DRIVALIA fleet, so they are already registered vehicles with the relevant seniority. The Be Free Evo product is subject to availability and limitations or restrictions may apply at certain times of the year or locations (e.g., peak season periods and/or tourist locations).

The subscription called "Be Free Evo" guarantees the customer the same conditions, published on drivalia.com and accepted when activating the service, for up to 24 months.

The customer, following registration and activation of the subscription on drivalia.com will be able to rent a vehicle with a minimum duration of 30 days and a maximum duration of 360 days. The customer agrees to return the original vehicle within the aforementioned maximum period of 360 days in order to proceed with the car exchange with simultaneous issuance of a new rental contract that will have a maximum duration of additional 360 days. At the end of the 24-month subscription period, the service will automatically terminate with no possibility of tacit renewal resulting in the customer's obligation to return the last vehicle in use at the time of said termination. The customer, if he/she does not fulfill the above commitment and does not return the vehicle within the aforementioned maximum vehicle holding period indicated in 360 days, declares that he/she is aware of the applicable regulations in this regard and, therefore, independently assumes all the obligations and burdens provided for (e.g., purely by way of simplification and not exhaustive, in tax matters, etc.). At the end of the 24-month subscription period, the service will automatically terminate with no possibility of tacit renewal resulting in the customer's obligation to return the vehicle. The subscription may not be subject to temporary suspension, however, the customer's right to terminate or withdraw as stated in the following paragraphs remains unaffected. It is understood that the booked rental is considered extended until the actual return of the vehicle. It will be the responsibility of the contract signatory to verify the validity and creditworthiness of the credit card registered in their personal area. The aforementioned payment instrument may be modified through the insertion of a new credit card to replace the one initially provided within 48 hours of the expiration of the 30th day of the rental period (expiration of the contract). Payment procedures and related data will be handled directly by the banking partner in charge of the transaction. The rental service will be billed monthly and in advance, until the natural expiration of the subscription, except if the service is terminated as described in the following paragraphs. The specific features of the Be Free Evo subscription service will be found in one's personal area by accessing from the website drivalia.com.

3. Mileage

The Be Free Evo monthly subscription fee includes 1,500 km/month of base mileage. This mileage can only be supplemented at the time of subscription activation with the purchase of an additional 1,500 km package, until a total mileage of 3,000 km/month is reached. The kilometers accrued in the purchased months will be made available for the following months until the termination of the subscription. On all occasions when any km in excess of the mileage included in the already used monthly subscriptions is detected, the company will invoice each extra km at a unit cost of €0.18 (VAT included). Unused kilometers during the period of validity of the subscription will not be usable thereafter nor will they be subject to any reimbursement by DRIVALIA S.p.A.

4. Protection Packages - Basic CDR Damage and TP Theft Service and Super Cover Service

When setting up the subscription, the customer will be asked to be able to choose between the two protection packages described below:

  • Basic CDR and TP Service - (included in subscription): includes the basic CDR and TP coverage services that provide a conventional reduction of the customer's liability in case of damages found during the rental or total/partial theft of the vehicle. The maximum amount that can be charged per event as a penalty varies depending on the car group rented, from a minimum of €1,200 to a maximum of €5,000, as better specified in the General Rental Conditions document.

  • Super Cover Service - (optional service): eliminates the amount owed by the Client for damage and theft with respect to the rented vehicle, as better specified in the documents "General Rental Conditions " document.

N.B. In case of total/partial theft or fire of the vehicle occurred in Campania, Puglia, Calabria or in the city of Catania and province, the Super Cover service does not eliminate in full the application of the penalty, but reduces by 50% the amount chargeable as a penalty that varies depending on the rented car group, as better specified in the document "General Rental Conditions"

IMPORTANT NOTICE **The CDR, TP and SUPER COVER SERVICES do not operate in the event that the driver's behavior is not diligent pursuant to Art. 1176 Civil Code and in any case the driver will not be able to avail himself of any limitation of liability in the event of negligence, willful misconduct or gross negligence pursuant to Art. 1229 Civil Code. In these cases, the Client is fully responsible for the compensation of the cost of the vehicle after documentary exchange between the parties regarding the event.

5. Scheduled Car Change

The customer, outside the assumptions of vehicle replacement in case of vehicle damage or malfunction, is required to make a scheduled car change between 300 and 360 days after delivery of each vehicle. The customer through his MY PLANET MOBILITY personal area, with a minimum notice of 48 working hours (this notice may at certain times of the year be subject to change), can book the return of the rented car and at the same time the pick-up of the new vehicle at the chosen DRIVALIA Mobility Store.

Upon the return of the original vehicle at the DRIVALIA Mobility Store, the customer can proceed to change cars and, therefore, to pick up the new vehicle and sign the new rental contract, which will have a maximum duration of additional 360 days. DRIVALIA will proceed to verify the relative availability of the requested vehicle on the scheduled day and place, giving confirmation by e-mail. After 24 hours from the date of reservation without the car being picked up, the reservation will be cancelled and the Customer will have to make a new request in accordance with the above terms.

6. Billing

The subscription fee for the Be Free Evo service will be charged every 30 days, via the credit card registered in the MY PLANET MOBILITY reserved area, at least 5 days in advance of the monthly service due date. The date of payment may, however, be subject to change without notice, by way of example and not limitation, in the event that the charge fails. Billing information will be available within the MY PLANET MOBILITY reserved area . Any penalties, ancillary services, and any other contractually stipulated items related to the use of the rental car (e.g., fuel, second drive, damage penalty, etc.) will be charged at the end of each rental used on the credit card registered in the personal area and/or on the credit card presented when the vehicle is picked up and in all cases in which a change of car will be made during the course of the subscription. This is without prejudice, in any case, to the right of DRIVALIA to charge indifferently one of the credit cards provided by the customer in order to be able to collect the fee and any other amount contractually provided.

7. Payment methods with plurality of credit cards

The customer agrees to pay to DRIVALIA the subscription fee and the contractually stipulated amounts exclusively by means of a financial credit card in the name of the holder who is the signatory of the rental agreement and issued in the country of residence of the same. The credit card must be valid and solvent at the time the vehicle is entrusted, therefore, you will be required to show this credit card and allow the acquisition of a security deposit of €1, excluding subscriptions related to premium category cars. It should be noted that for premium cars, a security deposit will be required, which varies depending on the car model rented, from a minimum of €1,000 (€500 + €500 on each card) to a maximum of €2,000 (€1,000 + €1,000 on each card), to be acquired on the credit cards presented when the vehicle is picked up. No cash, ATM cards, debit cards, visa electron or prepaid cards are accepted. In particular, the payment of the Be Free Evo subscription fee will be made by means of a financial credit card registered in the personal area. The customer is required to verify the actual validity and solvency of the payment instrument indicated in his/her MY PLANET MOBILITY personal area, throughout the duration of the Be Free Evo subscription.

DRIVALIA will charge the contractually due fee in the following manner: The Be Free Evo subscription fee will be charged monthly (every 30 days) to the credit card registered by the customer and associated with his or her account 5 days before the monthly subscription fee due date. any other contracted items (e.g., fuel, refueling service, extra miles, damages) may be charged to the credit card presented when the vehicle is picked up or to the credit card registered in the personal area; This is without prejudice, in any case, to the right of DRIVALIA to charge indifferently one of the credit cards provided by the customer in order to be able to collect the fee and any other amount contractually provided. In case of unsuccessful attempt to charge all credit cards provided by the customer, for any reason whatsoever, the holder will be held responsible for the accrued insolvency resulting in immediate interruption and termination of the Be Free Evo subscription service with simultaneous inability to enter new reservations. If the charge fails and the customer is in possession of a vehicle he/she will be required to immediately return the car to a DRIVALIA Mobility Store (see point T "General Rental Conditions ").

The customer also agrees to pay what is due by way of payment for the rental service used and related services, charges, and anything else contractually stipulated, including days in excess of the maximum allowable duration of the Be Free Evo subscription until the actual return of the vehicle, vehicle and credit recovery costs in case of late payment or insolvency.

8. Be Free Evo Subscription Levels and Prices

The customer will be able to choose from the subscription levels indicated on the drivalia.com website and rent the vehicles included in the chosen level under the conditions and costs published in the "PRICING" section of the produtc page of drivalia.com website. It should be noted that subscriptions for Tesla brand cars exclude any ancillary services provided directly by Tesla that customers can access at their own expense. Information on costs and services offered by Tesla is available on the Tesla website and in the Tesla APP.

9. DRIVALIA Be Free Evo subscription vehicle delivery

When picking up the vehicle, the Customer, the subscription holder, must sign the rental agreement and follow the entrustment procedures specified therein, providing a credit card in his or her name.

10. Charging modes Hybrids PLUG-IN/electric cars.

The electric and hybrid cars in the DRIVALIA fleet can be equipped with a standard domestic charging cable (3KW), a type 2 cable (22KW) and an EnelX RFID Card charging card. The customer can recharge the car, following the prescriptions in the vehicle's use and maintenance booklet, at home or at the DRIVALIA columns in the Mobility Stores enabled to the service, or at the public network Enel X or other partner company Enel A X in the latter cases, can use the type 2 cables and the RFID Card delivered at the beginning of the rental period.

The recharging service, dedicated to DRIVALIA customers through the RFID Card, will be charged to the customer according to the methods indicated in the document "List of Additional Services, Surcharges and Penalties" published on the website www.drivalia.com/it in the DOCUMENTS section.

In the event of theft, loss, damage, tampering of the domestic charging cable or type 2 cable, a penalty will be charged in the manner indicated in the document "List of Additional Services, Supplements and Penalties" published on the website www.drivalia.com/it in the DOCUMENTS section.

DRIVALIA reserves the right to block and request the return of the RFID Card, in the event of improper or abnormal use of the RFID Card that goes beyond the recharging related to the rented car or in the event of non-payment of the recharging service and any additional service related.

The Customer is aware of and undertakes to comply with the provisions of the Highway Code regarding parking at the parking bays intended for charging electric cars or electric vehicles in general.

It is specified that in case of failure to remove the car from the charging station stall within 60 minutes after the end of the charging session, DRIVALIA will charge for each minute after the sixtieth after the end of the charging session and until the plug is removed from the socket used the amounts indicated in the document "General Rental Conditions".

11. Cancellation

Notwithstanding the contractually stipulated minimum term of 30 days, for which no refund is allowed, the Customer has the right to give notice of cancellation of the subscription, without penalty, for the month following the first one with at least 10 days' notice from the renewal of the following month. Please note that no refunds or credits will be allowed for partially used monthly subscription periods or for days not used in whole or in part. Subscription cancellation can be done by logging on to your reserved area of drivalia.com website. Such termination will result in immediate termination of the relevant account, subject to verification of any ongoing billing issues.

12. Right of Withdrawal

It is however subject to the right of withdrawal of the Customer-Consumer as provided by the current legislation on consumer rights under Legislative Decree no. 6 September 2005 n. 206 (Consumer Code) and s.m.i. and Legislative Decree no. 9 April 2003 n. 70 on electronic commerce and s.m.i. In case of a request for withdrawal by the Customer-Consumer within 30 days of payment and simultaneous reservation of the subscription car, DRIVALIA will refund the amount already paid as a monthly rental fee provided that the rental service has not started. In the event that the rental has begun and in any case always within 30 days of payment, the Customer-Consumer may exercise this right of withdrawal, obtaining a refund of half of the rental subscription fee.

13. Express termination clause

The following will constitute cases of serious non-performance, upon the occurrence of which DRIVALIA will be entitled to terminate the Contract pursuant to Article 1456 of the Civil Code due to the Customer's act and fault and subject to compensation for further damage, by giving simple written notice by registered letter with return receipt or by PEC or email:

  • the customer fails to timely pay even a single subscription fee and/or contractually due extra charges;

  • Use of false credentials and documents or otherwise not traceable to the Customer, when signing up for the Subscription and/or booking and Hiring of vehicles;

  • the Customer, even at the request of the Company, fails to return a vehicle or fails to comply with the request for inspection of the vehicle;

  • Failure to pay penalties contractually stipulated and applied by the Manager;

  • Driving of the Hired Vehicle by a person other than the Subscription Customer, unless specified on the rental agreement as a second driver;

  • purposes of subletting and/or careless entrusting to third parties in any capacity.

The customer fails to fulfill the obligations under the following articles of these Terms and Conditions Be Free Evo point 2 Description of Service and minimum and maximum duration, point 5 "scheduled car exchange, point 7 Payment methods with multiple credit cards; The client fails to fulfill the obligations under the "The electric and hybrid cars in the DRIVALIA fleet can be equipped with a standard domestic charging cable (3KW), a type 2 cable (22KW) and an EnelX RFID Card charging card. The recharging service, dedicated to DRIVALIA customers through the RFID Card, will be charged to the customer according to the methods indicated in the document "List of Additional Services, Surcharges and Penalties" published on the website www.drivalia.com/it in the DOCUMENTS section.

In the event of theft, loss, damage, tampering of the domestic charging cable or type 2 cable, a penalty will be charged in the manner indicated in the document "List of Additional Services, Supplements and Penalties" published on the website www.drivalia.com/it in the DOCUMENTS section.

DRIVALIA reserves the right to block and request the return of the RFID Card, in the event of improper or abnormal use of the RFID Card that goes beyond the recharging related to the rented car or in the event of non-payment of the recharging service and any additional service related.

The Customer is aware of and undertakes to comply with the provisions of the Highway Code regarding parking at the parking bays intended for charging electric cars or electric vehicles in general.

Further information and costs of e-mobility services can be found in the document General Rental Conditions in particular: B) Delivery and return of the vehicle, D) Vehicle maintenance, E) Vehicle use, F) Basic and optional services, G) Accidents, damages, claims, H) The Customer agrees to pay DRIVALIAS.p.A. by credit card; there is unavailability of the client or the state of detention, or if the client is subject to precautionary, preventive and/or security measures, or is under investigation and has acquired the status of a defendant; the vehicle is subject to preventive and/or conservative seizure or, otherwise, to any real precautionary measure or, finally, is subject to confiscation. In all cases of early termination of the Lease, the Customer undertakes to pay to DRIVALIA in one lump sum any amount that has already accrued against him/her for fees, extra charges, penalties, vehicle and credit recovery costs, etc. Exercised the termination DRIVALIA, in the manner set forth above, DRIVALIA shall have the right to regain possession of the leased vehicle to the customer, even in the presence of opposition or dispute, including judicial, by the customer after sending a notice to be sent by email or racc A.R or electronic T-notice with the intimation to return the vehicle immediately or, in any case, no later than 24 h after sending the notice. The customer must return the leased vehicle to a DRIVALIA Mobility Store immediately and, in any case, no later than 24 h from the sending of the notice, without being able to demand and/or claim anything regarding the early termination.

  1. Applicable law and Jurisdiction

The contract of entered into between the Customer and DRIVALIA will be governed and interpreted in accordance with Italian Law. For any dispute arising from and/or related to the rental of the vehicle, as well as for any action necessary to recover the credit accrued by DRIVALIA S.p.A., the court of Rome will have jurisdiction. In the case of Customer-Consumer, for the resolution of any civil disputes arising from the interpretation, execution and termination of this contract, the mandatory territorial jurisdiction is the court of the place of residence or domicile of the consumer himself, if located in Italy (Art. 63 Legislative Decree 205/2006). In using the vehicle, the Customer shall abide by the rules of the Highway Code as well as the diligence required by Article 1176 of the Civil Code.

  1. Recall and acceptance of the General Terms and Conditions of the DRIVALIA Rental Agreement

By entering into this contract, the Client also declares that he/she has read the contents of the DRIVALIA Rental Agreement and the DRIVALIA General Terms and Conditions document viewable through the respective links.

  1. Changes to the general conditions of sale

DRIVALIA may at any time update and supplement or amend these "Be Free Evo Terms and Conditions", the provisions of the Rental Agreement and the Rental Terms and Conditions by means of publication on the befree-evo.drivalia.com website and by direct communication to the Customer at the e-mail address provided by the Customer during registration. The changes will be applied as of the beginning of the second month following the month in which DRIVALIA has announced them to the Customer in writing, unless legal regulations or administrative measures impose or result in an earlier application date. In case of disagreement, the Customer may withdraw without penalty from the Be Free Evo subscription, by communication by email to subscribe.drivalia@drivalia.com which must be received by DRIVALIA no later than 30 (thirty) days from the date of receipt of the communication from DRIVALIA . In such case, the termination will become effective at midnight of the day before the day on which the changes would otherwise have been applied. Should any provision of these Conditions be held invalid, void, or for any reason unenforceable, such condition shall not, however, affect the validity and enforceability of the other provisions. Any changes and/or additions will be effective from the date of their publication on the befree- evo.drivalia.com website.

  1. Password and account access

The Customer who has created his or her Be Free Evo profile ("Account Holder") is responsible for any activity he or she performs through his or her profile, for the safekeeping of passwords, for accesses to the service and shall not disclose to anyone the password and/or payment details associated with the account. It will also be the responsibility of the account holder to update the information regarding the profile and ensure that it is true. DRIVALIA will have the right to close or suspend the Client's profile in case of possible identity theft or doubts of fraudulent activity or in case of misuse in any capacity.

The Customer's data will be processed in accordance with the Privacy Code (Legislative Decree No. 196/2003) and EU Regulation No. 2016/679 (GDPR) and subsequent additions/changes.
