CarBox is a rental subscription service provided by DRIVALIA S.p.A. that entitles the customer to 240 days of flexible mobility that can be used within the next 12 months from the date of registration in a fractioned or continuous manner.

Introduction
CarBox is a subscription rental service provided in Italy by DRIVALIA S.p.A. reserved for customers residing in Italy (Individuals, Freelancers and Legal Persons) reserved for Amazon Voucher holders.
Following the purchase of the Amazon CarBox voucher, the Customer is entitled to register at carbox.drivalia.com and, upon reservation, to rent at DRIVALIA Mobility Stores enabled to the purchased subscription plan, at the price displayed in the offer, one of the car models included in the predetermined range.
Drivalia S.p.A. will provide the rental at enabled DRIVALIA Mobility Stores in the country upon acceptance of the following contractual documents:
1.CarBox Subscription Terms and Conditions, set forth in this document;
2."DRIVALIA Rental Agreement" and "General Terms and Conditions" which are hereby referred to and viewable through their respective links.
Subscribing to the CarBox Subscription Service will allow the user to rent one of the vehicles belonging to the chosen subscription level for a maximum period of 240 days to be used, either fractionally (minimum 1 day) or continuously (maximum 240 days divided into reservations of 30 days each), over a period of 12 months from the activation of the CarBox subscription.
The Customer can only be the holder of one CarBox subscription and must meet the following requirements to be eligible for the subscription service:
It is generally prohibited to sub-lease the vehicle in any capacity whatsoever, to entrust it to third parties not authorized by the lease agreement, to dispose of the vehicle contrary to or contrary to the provisions of the lease agreement (Rental Agreement Letter E- Use of Vehicle).
It remains subject to the unquestionable judgment of DRIVALIA to assess the requirements for access to the CarBox subscription, in accordance with the general conditions of the rental agreement (point 2 of the premises).
Subscription of the CarBox Subscription Service entitles the User to rent the selected vehicle belonging to the chosen subscription level for a period of 240 days to be used, fractionally or continuously, over a 12-month period from the activation of the subscription. The User can request the availability of the vehicle at least 24 working hours in advance (notice subject to change at certain times of the year) by indicating the period for which he wants to use the vehicle from a minimum of 1 day to a maximum of 240 days.
Based on the period the customer selects, the digital platform will generate the relevant reservation with a maximum duration of 30 days each renewable until the 240 days are exhausted.
The customer 24 h prior to the end of the current rental period, without application of any penalty, may choose if to continue his rental by entering the relevant extension period from his personal area.
At the end of each rental period, the customer is obliged to return the vehicle to a Mobility Store, unless he has entered and confirmed the continuation of the rental as described above.
Any extra days beyond the period specified in the booking will be invoiced separately until the actual return of the vehicle at a cost of EUR 24 per day for all car models and subscription levels and will not count towards the days included in the CarBox subscription.
It is understood that the booked rental is considered ongoing until the actual return of the vehicle.
At the end of 12 months, the subscription will end automatically without the possibility of tacit renewal.
The customer agrees at the end of the 240 days of mobility included in the subscription, as well as in case of its termination for any reason, to immediately return the vehicle to a Mobility Store.
In the event that before the conclusion of the 12-month subscription period, the customer has already used the 240 days of rental available to him or her, he or she will be required to return the car and pay the scheduled monthly amount for the 12 months until the natural expiration of the subscription, subject to the cancellation option indicated in Section 9.
In any case of undue detention of the vehicle by the Customer at the end of the 240 rental days included in the subscription and/or in case of payment default DRIVALIA will order the immediate return of the vehicle and may take any action, including legal action, for its own protection.
In any case, this is without prejudice to DRIVALIA's right, in its sole discretion, to require the return of the vehicle and/or not to replace it upon the outcome of the assessments of the requirements of the general rental contract conditions. Furthermore, DRIVALIA, during the CarBox subscription, reserves the right not to provide a replacement vehicle in the event of an accident, breakdown, theft, damage or for any other reason at its sole discretion, without having to justify such refusal ("DRIVALIA Rental Agreement" and "General Terms and Conditions").
Payment for the CarBox subscription will be made by means of a financial credit card registered in the personal area of the CarBox website. In addition, at the time the vehicle is entrusted, the subscription holder will be asked to show a financial credit card in his or her name in order to enable the acquisition of a security deposit, as provided for in the DRIVALIA General Terms and Conditions that can be consulted at the following "link" for the payment of any penalties, ancillary services and any other contractually provided items related to the use of the rental car (e.g. fuel, second drive, damage penalty, etc. ).
It will be the responsibility of the contract signatory to verify the validity and creditworthiness of the credit card registered in their personal area. The aforementioned payment instrument may be changed through the insertion of a new credit card to replace the one initially provided within 10 days of the expiration of the current monthly payment.
Payment procedures and related data will be handled directly by the e-commerce provider in charge of handling online payments. The subscription fee will be billed every 30 days from the date of activation of the service until the natural expiration of the 12 months provided, with the exception of the hypothesis of successful termination of the service as described in the following paragraphs. The specific features of the CarBox subscription service will be available in your personal area.
Mileage
Unlimited mileage is provided for each CarBox booking of duration from 1 to 29 days, while 1500 km is included for bookings of 30 continuous days. On all occasions when any mileage in excess of the mileage included in the reservation is detected, the company will invoice each extra mileage in the manner set forth in "DRIVALIA Terms and Conditions" accessible at the following link: https://www.drivalia.com/it/ita/terms-conditions.
Protection packages - Basic CDR Property and TP theft service "BASIC" and Super Cover service "INCLUSIVE"
When setting up the subscription, the customer will be asked to choose between the two protection packages described below:
- Basic CDR and TP service (BASIC - included in subscription): includes the basic CDR and TP coverage services that provide a conventional reduction of the customer's liability in case of damages found during the rental or total/partial theft of the vehicle. The maximum amount that can be charged per event as a penalty varies depending on the car group rented, from a minimum of €1,200 to a maximum of €5,000, as further specified in the "Rental Agreement" and "DRIVALIA Terms and Conditions" documents.
- Super Cover Service (INCLUSIVE - optional service): eliminates the amount owed by the Client for damage and theft with respect to the rented vehicle, as better specified in the documents "Rental Agreement" and "DRIVALIA Terms and Conditions". N.B. In case of total/partial theft or fire of the vehicle occurred in Campania, Puglia, Calabria or in the city of Catania and province, the Super Cover service does not eliminate in full the application of the penalty, but reduces by 50% the amount chargeable as a penalty that varies depending on the rented car group, as better specified in the document "General Terms and Conditions DRIVALIA" viewable through the following "link").
IMPORTANT NOTICE
**The CDR, TP and SUPER COVER SERVICES do not operate in the event that the driver's behavior is not diligent pursuant to Art. 1176 Civil Code and in any case the driver will not be able to avail himself of any limitation of liability in the event of negligence, willful misconduct or gross negligence pursuant to Art. 1229 Civil Code. In these cases, the Client is fully responsible for the compensation of the cost of the vehicle after documentary exchange between the parties regarding the event.
Billing
The subscription fee for the CarBox service will be charged every 30 days, via the credit card registered in the "Payment Management" section of the restricted area, at least 5 days in advance of the monthly service due date. The date of payment may, however, be subject to change without notice, by way of example and not limitation, in the event that the charge fails. Billing information will be available within the restricted area of the site in the "Your Subscription" section.
Any penalties, ancillary services and any other contractually stipulated items related to the use of the rental car (e.g. fuel, second drive, damage penalty, etc.) will be charged at the end of each rental used on the credit card presented and registered when the vehicle is picked up. This is without prejudice, in any case, to the right of DRIVALIA to charge indifferently one of the credit cards provided by the customer in order to be able to collect the fee and any other amount contractually provided.
Payment methods with plurality of credit cards
The client agrees to pay DRIVALIA the subscription fee and the contracted amounts exclusively by financial credit card. Payments by cash, ATM cards, debit cards, visa electron or prepaid cards are not accepted. Specifically, payment of the CarBox subscription fee will be made by financial credit card indicated on the carbox.drivalia.com website. The customer is required to verify the actual validity and solvency of the payment instrument indicated in his or her reserved area, throughout the duration of the CarBox subscription.
DRIVALIA will charge the contractually due fee in the following manner:
The CarBox subscription fee will be charged monthly to the credit card registered by the customer and associated with their account 5 days before the monthly subscription fee is due.
Any other contracted items (e.g., fuel, refueling service, extra miles, damages) may be charged to the credit card presented when the vehicle is picked up;
This is without prejudice, in any case, to the right of DRIVALIA to charge indifferently one of the credit cards provided by the customer in order to be able to collect the fee and any other amount contractually provided.
In case of unsuccessful attempt to charge all credit cards provided by the customer, for any reason whatsoever, the holder will be held responsible for the accrued insolvency resulting in the immediate interruption and termination of the CarBox subscription service with simultaneous inability to enter new reservations. If the charge is unsuccessful and the customer is in possession of a vehicle he/she will be required to immediately return the car to a DRIVALIA Mobility Store ( see point T "DRIVALIA Rental Agreement").
The customer also agrees to pay what is due by way of payment for the rental service used and related services, charges, and anything else contractually stipulated, including days in excess of the maximum permitted duration of the CarBox subscription.
CarBox Subscription Levels and Prices
The customer can choose from the subscription levels listed on carbox.drivalia.com and rent the vehicles included in the chosen level at the conditions and costs published in the "PRICE LIST AND SUBSCRIPTION LEVELS" section of carbox.drivalia.com.
CarBox subscription vehicle delivery
When picking up the vehicle, the Customer must sign the rental agreement and follow the entrustment procedures outlined therein, providing financial credit card in the name of the season ticket holder as well as the first driver of the vehicle.
Cancellation
The Customer has the right to terminate the subscription with at least 10 days' notice of the next monthly payment. Subscription cancellation can be made by logging into your reserved area in the "Your Subscription" section of carbox.drivalia.com. Such cancellation will result in the immediate closure of the relevant account, subject to verification of any ongoing billing issues, and the return of the vehicle. In the event of cancellation, DRIVALIA will make an adjustment between the rental days used and the fees paid by the customer with respect to which the following assumptions can be made:

The contract will be considered terminated only upon actual payment of the adjustment invoice issued by DRIVALIA.
Right of Withdrawal
The Customer, if qualifying as a Consumer under Legislative Decree No. 206 of September 6, 2005, may exercise the right of reconsideration, without any penalty and without specifying the reason, only if he/she has never used the Service, by written notice to be sent to the Manager, within the terms indicated below, by e-mail to: cs@drivalia.com In the event of a request for withdrawal by the Consumer Customer within 30 (thirty) days from the activation of the CarBox subscription, DRIVALIA will provide a full refund of the amount already paid provided that the rental service has not begun.
Express termination clause
The following will constitute cases of serious non-performance, upon the occurrence of which DRIVALIA will be entitled to terminate the Contract pursuant to Article 1456 of the Civil Code due to the Customer's act and fault and subject to compensation for further damage, by giving simple written notice by registered letter with return receipt or by PEC or email:
In all cases of early termination of the Lease, the Customer undertakes to pay to DRIVALIA in a lump sum any amount that has already accrued against him/her for fees, extra charges, penalties, etc.
Having exercised the termination DRIVALIA, in the manner set forth above, DRIVALIA shall have the right to regain possession of the leased vehicle to the customer, even in the presence of opposition or dispute, even judicial, by the customer upon sending a notice to be sent by email or racc A.R with the intimation to return the vehicle immediately or, in any case, no later than 24 h after sending the notice.
The customer must return the leased vehicle to a Mobility Store immediately and, in any case, no later than 24 h from the sending of the notice, without being able to request and/or claim anything regarding the early termination.
Charging modes Hybrid PLUG-IN/electric cars
The electric and hybrid cars in the DRIVALIA fleet can be equipped with standard domestic charging cable (3KW), type 2 cable (22 KW), and EnelX RFID Card charging card, as indicated in the relevant report.
The customer can recharge the car, following the prescriptions in the vehicle's owner's manual, at his or her home or at DRIVALIA charging stations in enabled DRIVALIA Mobility Stores (see list published on mobilitystore.drivalia.com in the E-parking section), or at the Enel X public network or Enel X contracted partners using the EnelX RFID Recharge Card.
The charging service made available at the enabled DRIVALIA Mobility Stores and at the Enel X public network or Enel X contracted partners will be charged to the customer according to the terms indicated in the DRIVALIA General Terms and Conditions document.
In case of theft, loss, damage, tampering of the domestic charging cable or type 2 cable or RFID Card will be charged a penalty fee, the amount of which is specified in the DRIVALIA General Terms and Conditions document.
DRIVALIA reserves the right to block and require the return of the RFID Card, in case of improper or abnormal use (maximum 100 KW per day) of the same which is beyond the recharge related to the rental car.

Applicable law and Jurisdiction
The contract entered into between the Customer and DRIVALIA will be governed by and interpreted in accordance with Italian Law. For any dispute arising from and/or connected with the rental of the vehicle, as well as for any action necessary for the recovery of the credit accrued by DRIVALIA S.p.A., the Court of Rome will have jurisdiction. In the case of Customer - Consumer, for the resolution of any civil disputes arising from the interpretation, execution and termination of this contract, the mandatory territorial jurisdiction is of the judge of the place of residence or domicile of the consumer himself, if located in Italy (Art. 63 D. Lgs. 205/2006).
In using the vehicle, the Customer shall abide by the rules of the Highway Code as well as the diligence required by Article 1176 of the Civil Code.
Recall and acceptance of the General Terms and Conditions of the DRIVALIA Rental Agreement
By entering into this contract, the Client also declares that he/she has read the contents of the DRIVALIA Rental Agreement and the DRIVALIA General Terms and Conditions document viewable through the respective links.
Changes to the general conditions of sale
DRIVALIA may at any time update and supplement or amend these "CarBox Terms and Conditions", the provisions of the Rental Agreement and the Rental Terms and Conditions by means of publication on the website carbox.drivalia.com and by direct communication to the Customer at the e-mail address provided by the Customer during registration.
The changes will be applied as of the beginning of the second month following the month in which DRIVALIA has announced them to the Customer in writing, unless legal regulations or administrative measures impose or result in an earlier application date.
In case of disagreement, the Customer may withdraw without penalty from the CarBox subscription, by notice by email to subscribe.drivalia@drivalia.com which must be received by DRIVALIA no later than 30 (thirty) days from the date of receipt of the notice from DRIVALIA. In this case, the termination will become effective at midnight of the day before the day on which the changes would otherwise have been applied.
Should any provision of these Conditions be held invalid, void, or for any reason unenforceable, such condition shall not, however, affect the validity and enforceability of the other provisions. Any changes and/or additions will be effective from the date of their publication on carbox.drivalia.com
Password and account access
The Customer who has created his or her CarBox profile ("Account Holder") is responsible for anyactivity he or she performs through his or her profile, for the safekeeping of passwords, for accesses to the Service and shall not disclose to anyone the password and/or payment details associated with the account. It will also be the responsibility of the account holder to update the information regarding the profile and ensure that it is true. DRIVALIA shall have the right to close or suspend the Customer's profile in case of possible identity theft or doubts of fraudulent activity or in case of misuse in any capacity or in case of insolvency or failure to return the vehicle.
Privacy and Communications
The Customer's data will be processed in accordance with the Privacy Code (Legislative Decree No. 196/2003) and EU Regulation No. 2016/679 (GDPR) and subsequent additions/changes.
