CarCloud is a monthly subscription rental service provided by DRIVALIA S.p.A. reserved to CarCloud Subscription Voucher holders purchased through Amazon website, drivalia.com website or at Mobility Store.

Premises
CarCloud is a monthly rental subscription service provided by DRIVALIA S.p.A. reserved to customers resident in Italy (private individuals, freelancers and companies) and in possession of a CarCloud Subscription Voucher purchased through the Amazon website, drivalia.com website or from Mobility Store.
DRIVALIA S.p.A. will provide the rental at all Mobility Stores in Italy upon acceptance of the following contractual documents:
Amazon CarCloud Terms and Conditions, which are hereby recalled and can be viewed on the Amazon CarCloud product page;
CarCloud Subscription Terms and Conditions, referenced herein;
"General rental conditions" which are hereby recalled and viewable through the following link.
The personalized subscription service called "CarCloud" allows you to reserve, at the rates displayed on drivalia.com, a rental vehicle with a minimum duration of 30 days and a maximum of 12 months. At the end of the 12-month subscription period, the contract will terminate automatically without the possibility of tacit renewal. In any case, this is without prejudice to the right of DRIVALIA, at its sole discretion, to require the return of the vehicle and/or not to replace it at the outcome of the evaluations of the requirements of the general conditions of the rental contract. DRIVALIA, during the CarCloud subscription, reserves the right not to provide a replacement vehicle in the event of an accident, breakdown, theft, damage or for any other reason at its sole discretion, without having to justify such refusal ("DRIVALIA General rental conditions").
These conditions regulate the use of the aforementioned service, meaning "Service" means the provision of rental cars with a predetermined duration of 30 days, provided by DRIVALIA.
The Customer, who is a signatory of the rental contract, can only be the holder of one CarCloud subscription and, in any case, the holder of only one subscription among those offered by DRIVALIA, furthermore, in order to have access to the subscription service, he/she must have the following requirements:
Possession of an "Entry voucher" previously purchased on amazon.com or at Mobility Store or on the drivalia.com website
Possession of a valid driver's license that has been valid for at least one year;
Minimum age of 21 years
Possession of a valid ID document;
Possession of tax identification number and residence in Italy;
Possession of a credit card in the name of the contract holder and issued in the customer's country of residence, which must be shown compulsorily when collecting the car as a valid means of payment (ATM cards, debit cards, visa electron or prepaid cards are not allowed).
It should be noted that for premium cars, as specified in the General Rental Conditions document, the customer, a signatory of the rental agreement, must provide 2 financial credit cards in his or her name, both issued in the same country of residence of the customer, in order to allow on each of the cards presented the acquisition of a security deposit. More information on the security deposit amounts can be found in the PRICE LIST SECURITY DEPOSIT AMOUNTS document available in the DOCUMENTS section of the website.
For the subscription related to Mini Car (heavy quadricycle category L7E ex Art. 47 Highway Code) the second driver may be at least 16 years old and have held a B1 license for at least 6 months.
It is generally prohibited to sub-lease the vehicle in any capacity whatsoever, to entrust it to third parties not authorized by the lease agreement, to dispose of the vehicle contrary to or contrary to the provisions of the lease agreement (GENERAL RENTAL CONDITIONS Letter E- Use of Vehicle). It remains subject to the unquestionable judgment of DRIVALIA to assess the requirements for access to the 'CarCloud subscription, in accordance with the GENERAL RENTAL CONDITIONS.
Following the purchase of the subscription voucher on the Amazon site or at Mobility Stores or on drivalia.com website, the Customer is entitled to register on the DRIVALIA website and, upon reservation, to rent at Mobility Stores enabled to the purchased subscription plan, at the price displayed in the offer, one of the car models included in the predetermined range. The registration voucher is valid for 30 days from the date of purchase, and within that period the customer must enter the vehicle reservation indicating a pickup date within the next 30 days. The CarCloud product is subject to availability and limitations or restrictions may apply at certain times of the year or locations (e.g., peak season periods and/or tourist locations). Within this range of vehicles, the Customer may request to exchange the rental car for a lost car with a minimum of 48 business hours notice (this notice may at certain times of the year be subject to change), at no additional cost (subject to verification of the availability of the requested car at the desired date and location). The CarCloud rental car subscription will have a minimum duration of 30 days and, if not cancelled, will renew 30 days at 30 days, with the maximum duration of 12 months from the date of collection of the vehicle indicated in the reservation. The subscription cannot be subject to temporary suspension, however, the customer's right to cancel or terminate as indicated in the following paragraphs remains unaffected.
At the end of the 12-month subscription period, the contract will automatically terminate without the possibility of tacit renewal and the customer, upon request, will be made a new offer aimed at meeting his or her mobility needs. It is understood that the booked rental is considered extended until the actual return of the vehicle. The payment of the CarCloud subscription will be made exclusively by means of a credit card in the name of the holder signing the rental agreement and issued in the country of residence of the same. The credit card must be valid and solvent at the time the vehicle is entrusted, therefore, it will be required to show this credit card and allow the acquisition of a security deposit of € 1, excluding subscriptions related to premium category cars.
It should be noted that for premium cars, a security deposit will be required, which varies depending on the car model rented, from a minimum of €1,000 (€500 + €500 on each card) to a maximum of €2,000 (€1,000 + €1,000 on each card), to be acquired on the credit cards presented when the vehicle is picked up. It will be the responsibility of the contract signatory to verify the validity and creditworthiness of the credit card registered in their personal area. The aforementioned payment instrument may be modified through the insertion of a new credit card to replace the one initially provided within 48 hours of the expiration of the 30th day of the rental (expiration of the contract). The payment procedures and related data will be handled directly by the banking partner in charge of the transaction.
The rental service will be billed monthly and in advance, until the natural expiration of the subscription, except in the event of the service being terminated as described in the following paragraphs. The specific features of the CarCloud subscription service will be available in your personal area by accessing from the dedicated website drivalia.com.
The CarCloud monthly subscription fee includes 1,500 km/month of base mileage. This mileage can be supplemented with the purchase of a package of 1,500 additional km, until a total mileage of 3,000 km/month is reached. The kilometers accrued in the purchased months will be made available for the following months until the termination of the subscription. On all occasions when any km in excess of the mileage included in the already used monthly subscriptions is detected, the company will invoice each extra km at a unit cost of €0.18 (VAT included).
Unused kilometers during the period of validity of the subscription will not be usable thereafter nor will they be subject to any reimbursement by DRIVALIA S.p.A.
Included in the CarCloud subscription fee is the CDR service which provides for a conventional reduction of the Customer's liability, for damages found on the car during the rental period within the limits of a maximum amount chargeable per event, which varies depending on the car group rented as a penalty (from a minimum of €1,200 to a maximum of €5,000), as better specified in the PRICE LIST OF EXTRA SERVICES, SURCHARGES AND PENALTIES document available in the DOCUMENTS section of the website.
In addition, included in the CarCloud subscription fee is the TP Theft service, which provides for a conventional reduction of the Customer's liability in the event of total and/or partial theft or fire, within the limits of a maximum amount chargeable per event that varies depending on the car group rented by way of penalty, (from a minimum of 2,000 € to a maximum of 5,000 €), as better specified in the PRICE LIST OF EXTRA SERVICES, SURCHARGES AND PENALTIES document available in the DOCUMENTS section of the website.
Within the range of cars offered in the chosen CarCloud subscription service, the Customer may request the replacement of the car model, with a minimum notice of 48 working hours (this notice may at certain times of the year be susceptible to change), by logging in to its reserved area and submitting the appropriate request.
DRIVALIA will proceed to verify the relative availability of the requested vehicle on the scheduled day and place, giving confirmation by email and, in any case, without such substitution being binding where operational/availability requirements hinder its execution (by way of example, periods of high season and/or tourist locations). After 24 hours from the date of reservation without the car being picked up, the reservation will be cancelled and the Client must make a new request in compliance with the above terms.
Replacement of the rental vehicle may take place through the following alternative ways:
Delivery of the rental vehicle and pickup of the new model at one of the Mobility Stores in Italy enabled to the purchased subscription plan, with no extra charge.
Delivery of rental vehicle at one of the Mobility Stores in Italy and pickup of the new model at a Mobility Store lost from the delivery one and enabled to the purchased subscription plan, with no extra charge.
Delivery of the rental vehicle and/or pickup of the new model at an address provided by the Customer with a surcharge for car delivery service in urban and/or suburban area (see PRICE LIST OF EXTRA SERVICES, SURCHARGES AND PENALTIES document available in the DOCUMENTS section of the website.).
The subscription fee for the CarCloud service and any other services requested online and/or related to the use of the rental car, e.g., charges for accessories and any other contracted items, will be charged monthly, via the credit card registered and/or presented at the time of delivery of the car, 5 days prior to the expiration of the 30th day of rental. This payment date may, however, be subject to change without notice, by way of example and not limitation in the event that the charge fails.
Billing information will be available within the Customer's private area MY PLANET MOBILITY of drivalia.com.
The rental subscription amount is predetermined based on the CarCloud service chosen.
During the course of the subscription, it is permissible to add or remove any ancillary services available online within the designated area, or to request a switch from one subscription plan to another (e.g., switch from CarCloud Metropolis Plus to e-CarCloud Electric Style or vice versa) within 5 days before the expiration of the 30th rental day.
It should be noted that in case of a request during the subscription of the services "Super Cover" and/or "Second Guide" and/or a Plan Change by the customer, the customer must go to the chosen DRIVALIA Mobility Store on the date indicated in the reservation, for the actual activation of these services. Should the customer fail to appear at the Mobility Store, the activation of the requested services or Plan Change will not be considered valid. It is understood that all contract or service changes requested by the customer during the course of the subscription will take effect from the following month.
The customer can choose from the subscription plans listed on carcloud.drivalia.com and rent the vehicles included in the chosen plan at the conditions and prices published in the "LIST" section of the dedicated website. All CarCloud accessories can be purchased exclusively online through the customer's personal account at the prices published on carcloud.drivalia.com in the "LIST" section. It should be noted that subscriptions for Tesla brand cars exclude any ancillary services provided directly by Tesla that customers can access at their own expense. Information on costs and services offered by Tesla is available on the Tesla website and in the Tesla APP.
Payment for the rental service (CarCloud subscription fee and CarCloud ancillary services purchased online) will be made by credit card indicated on the CarCloud website. The customer will have the burden of verifying the actual validity and solvency of the indicated payment instrument in his or her private area, throughout the duration of the CarCloud subscription. The CarCloud subscriber may enter a new credit card to replace the one previously provided, no later than 3 days before the expiration of the monthly subscription fee (plurality of payment methods).
DRIVALIA will charge the contractually due fee in the following manner:
The CarCloud subscription fee and CarCloud ancillary services (purchased online) will be charged to the credit card registered by the customer and associated with their account 5 days prior to the expiration of the monthly subscription fee
Any other contracted items (e.g., fuel, refueling service, extra miles, damages) may be charged to the credit card registered by the customer and associated with his or her account and/or the credit card presented when the vehicle is picked up;
In case of an unsuccessful attempt to charge the issued credit card(s), for any reason whatsoever, the holder will be held responsible for the accrued insolvency resulting in the immediate termination of the CarCloud subscription service and the concomitant obligation to return the car at Mobility Store (see point T "DRIVALIA General Rental Conditions"). The customer also agrees to pay what is due by way of payment for the rental service used and related services, charges, and anything else contractually stipulated, including days in excess of the contract expiration date or the maximum allowable duration of the CarCloud subscription. In particular, days in excess of the expiration date of the contract or the maximum allowed duration and the related accessories and charges will be billed separately until the actual return date of the vehicle with appropriate tariff in accordance with the general terms and conditions of the rental contract.
When picking up the vehicle, the Customer must sign the rental agreement and follow the entrustment procedures outlined therein, providing credit card in the name of the season ticket holder as well as the first driver of the vehicle.
The electric and hybrid cars in the DRIVALIA fleet can be equipped with a standard domestic charging cable (3KW), a type 2 cable (22KW) and an EnelX RFID Card charging card. The customer can recharge the car, following the prescriptions in the vehicle's use and maintenance booklet, at home or at the DRIVALIA columns in the Mobility Stores enabled to the service, or at the public network Enel X or other partner company Enel A X in the latter cases, can use the type 2 cables and the RFID Card delivered at the beginning of the rental period.
The recharging service, dedicated to DRIVALIA customers through the RFID Card, will be charged to the customer according to the methods indicated in the document "List of Additional Services, Surcharges and Penalties" published on the website www.drivalia.com/it in the DOCUMENTS section.
In the event of theft, loss, damage, tampering of the domestic charging cable or type 2 cable, a penalty will be charged in the manner indicated in the document "List of Additional Services, Supplements and Penalties" published on the website www.drivalia.com/it in the DOCUMENTS section.
DRIVALIA reserves the right to block and request the return of the RFID Card, in the event of improper or abnormal use of the RFID Card that goes beyond the recharging related to the rented car or in the event of non-payment of the recharging service and any additional service related.
The Customer is aware of and undertakes to comply with the provisions of the Highway Code regarding parking at the parking bays intended for charging electric cars or electric vehicles in general.
It is specified that in case of failure to remove the car from the charging station stall within 60 minutes after the end of the charging session, DRIVALIA will charge for each minute after the sixtieth after the end of the charging session and until the plug is removed from the socket used the amounts indicated in the document "General Rental Conditions".

Notwithstanding the contractually stipulated minimum term of 30 days, for which no refund is allowed, the Customer has the right to give notice of cancellation of the subscription, without penalty, for the month following the first one with at least 10 days' notice from the renewal of the following month. Please note that no refunds or credits will be allowed for partially used monthly subscription periods or for days not used in whole or in part. Subscription cancellation can be done by logging in to your My planet Mobility reserved area of drivalia.com.
Such termination will result in immediate termination of the relevant account, subject to verification of any ongoing billing issues.
It is in any case without prejudice to the right of withdrawal of the Customer-Consumer as provided by the current legislation on consumer rights under D.lgs.6 September 2005 n. 206 (Consumer Code) and s.m.i. and D.lgs.9 April 2003 n. 70 on electronic commerce and s.m.i. In case of a request for withdrawal by the Customer-Consumer within 30 days after payment and simultaneous reservation of the subscription car, DRIVALIA will refund the amount already paid as a monthly rental fee provided that the rental service has not started. In the event that the rental has begun and in any case always within 30 days of payment, the Customer-Consumer may exercise this right of withdrawal, obtaining a refund of half of the rental subscription fee.
The following will constitute cases of serious non-performance, upon the occurrence of which DRIVALIA will be entitled to terminate the Contract pursuant to Article 1456 of the Civil Code due to the Customer's act and fault and subject to compensation for further damage, by giving simple written notice by registered letter with return receipt or by PEC or email:
the customer fails to timely pay even a single subscription fee and/or extra charges contractually due;
use of false credentials and documents or otherwise not traceable to the Customer, when signing up for the Subscription and/or booking and Hiring of vehicles;
the Customer, even at the request of the Company, fails to return a vehicle or fails to comply with the request for inspection of the vehicle;
non-payment of penalties contractually stipulated and applied by the Manager;
driving of the Hired Vehicle by a person other than the Subscription Customer, unless specified on the rental agreement as a second driver;
purposes of subletting and/or careless reliance on third parties in any capacity. ∙ The customer fails to fulfill the obligations under the following articles of these CarCloud Terms and Conditions point 2 Description of Service and minimum and maximum duration, point 8 Payment methods with plurality of credit cards; ∙ The customer fails to fulfill the obligations under the "DRIVALIA General Rental Conditions and in particular: B) Vehicle delivery and return, D) Vehicle maintenance, E) Vehicle use, F) Basic and optional services, G) Accidents, damages, claims, H) The Customer undertakes to pay DRIVALIA S.p.A. by credit card;
there is unavailability of the client or the state of detention, or if the client is subject to precautionary, preventive and/or security measures, or is under investigation and has acquired the status of a defendant;
the vehicle is subject to preventive and/or conservative seizure or, otherwise, to any real precautionary measure or any real preventive measure or, finally, is subject to confiscation.
In all cases of early termination of the rental, the Customer agrees to pay to DRIVALIA in a lump sum any amount that has already accrued to the Customer for fees, extra charges, penalties, vehicle and credit recovery costs, etc.
Exercised the termination DRIVALIA, in the manner set forth above, DRIVALIA shall have the right to regain possession of the leased vehicle to the customer, even in the presence of opposition or dispute, including judicial, by the customer after sending a notice to be sent by email or racc A.R or electronic T-notice with the intimation to return the vehicle immediately or, in any case, no later than 24 h after sending the notice.
The customer must return the leased vehicle to a Mobility Store immediately and, in any case, no later than 24 h from the sending of the notice without being able to request and/or claim anything in regard to the early termination.
The contract of entered into between the Customer and DRIVALIA will be governed and interpreted in accordance with Italian Law. For any dispute arising from and/or related to the rental of the vehicle, as well as for any action necessary to recover the credit accrued by DRIVALIA Spa will be competent the Court of Rome. In the case of Customer-Consumer, for the resolution of any civil disputes arising from the interpretation, execution and termination of this contract, the mandatory territorial jurisdiction is the court of the place of residence or domicile of the consumer himself, if located in Italy (Art. 63 Legislative Decree 205/2006). In using the vehicle, the Customer shall abide by the rules of the Highway Code as well as the diligence required by Article 1176 of the Civil Code.
By entering into this contract, the Customer also declares that he/she has read the contents of the DRIVALIA General Rental Conditions document.
DRIVALIA may at any time update and supplement or amend these "CarCloud Terms and Conditions", the provisions of the DRIVALIA General Rental Agreement and the Rental Terms andConditions by means of publication on the website drivalia.com and by direct communication to the Customer at the e-mail address provided by the Customer during registration. The changes will be applied as of the beginning of the second month following the month in which DRIVALIA has announced them to the Customer in writing, unless legal regulations or administrative measures impose or result in an earlier application date. In case of disagreement, the Customer may withdraw without penalty from the CarCloud subscription, by notice by email to subscribe.drivalia@drivalia.com which must be received by DRIVALIA no later than 30 (thirty) days from the date of receipt of the notice from DRIVALIA. In such case, the termination will become effective at midnight of the day preceding the day on which the changes would otherwise have been effective. Should any provision of these Conditions be deemed invalid, void or for any reason unenforceable, such condition shall not affect the validity and enforceability of the other provisions. Any amendments and/or additions shall be effective as of the date of their publication on carcloud.drivalia.com.
The Customer who has created his or her MY Planet Mobility profile ("Account Holder") is responsible for any activity he or she performs through his or her profile, for the safekeeping of passwords, for accesses to the Service and shall not disclose to anyone the password and/or payment details associated with the account. It will also be the responsibility of the account holder to update the information regarding the profile and ensure that it is true. DRIVALIA will have the right to close or suspend the Client's profile in case of possible identity theft or doubts of fraudulent activity or in case of misuse in any capacity.
The Customer's data will be processed in accordance with the Privacy Code (Legislative Decree No. 196/2003) and EU Regulation No. 2016/679 (GDPR) and subsequent additions/changes.
